2011 CHEEZBURGER SURVEY GIVEAWAY OFFICIAL RULES

1.    ELIGIBILITY. The 2011 Cheezburger Survey Giveaway (this “Promotion”) is open only to individual persons (each, an “Entrant”) who are legal residents of the United States and are 18 years of age or older at the time of entry. Limit one entry per person. Officers, directors, employees, contractors, representatives and agents of Cheezburger, Inc. (“Sponsor”) and its parent company, and each of their respective immediate families and household members are not eligible to enter this Promotion.

2.    ENTRY PERIODS.  The Promotion begins at 9 am PDT on March 31, 2011 and ends at 1 pm (the “End Time”) on April 5, 2011 (the “Promotion Period”). The Promotion Period will be divided into three (3) entry periods (each, an “Entry Period”) as set forth below.

3.    HOW TO ENTER.  During Entry Period 1, go to http://FAILBLOG.org and Click on the Top Left link to access the User Survey being hosted on Polldaddy.com* and complete all information and answer all questions on the survey, then provide Full Name and Email Identification. During Entry Period 2, go to http://MEMEBASE.com and Click on the Top Left link to access the User Survey being hosted on Polldaddy.com* and complete all information and answer all questions on the survey, then provide Full Name and Email Identification. During Entry Period 3, go to http://thedailywh.at/ and Click on the Top Left link to access the User Survey being hosted on Polldaddy.com* and complete all information and answer all questions on the survey, then provide Full Name and Email Identification. By successfully transmitting a completed survey questionnaire as instructed, you will be entered in the applicable Entry Period. All information submitted online by entrants is subject to, and will be treated in a manner consistent with, Cheezburger’s Terms of Service and Use located at: http://corp.cheezburger.com/legal/terms-of-service/ and Privacy Policy accessible at: http://corp.cheezburger.com/legal/privacy-policy/. All entries must include a valid e-mail address for the entrant.

4.    DRAWING; ODDS OF WINNING: One (1) potential winner (each, a “Winner” and collectively, the “Winners”) will be selected by random drawing on or about each Drawing Date from among all eligible entries received for the applicable Entry Period. The decisions of Sponsor are final and binding on all matters relating to this Promotion. Odds of winning depend on the total number of eligible entries received for the applicable Entry Period.

5.    PRIZES: Three (3) prizes (i.e. one for each Entry Period) will be awarded. Each Winner will receive one (1) fifty-dollar ($50.00) Amazon.com* gift card (approximate retail value of each Prize: $50). Each Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). The Prize cannot be substituted, exchanged or transferred, except that Cheezburger reserves the right, in its sole discretion, to substitute a prize of equal or greater value.

6.    NOTIFICATION: Each potential Winner will be notified at the e-mail address provided at the time of entry (the “Prize Notification”). In the event that any potential Winner does not respond to any such Prize Notification within three (3) days of the date of issuance, a disqualification will result and prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential Winner may be randomly selected from among all remaining eligible entries for the drawing at issue. Each potential Winner will be required to return an Affidavit of Eligibility and Liability/Publicity Release within five (5) days of date of issuance. Failure to submit any identification required by Sponsor or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any Prize or Prize Notification as undeliverable may result in disqualification and prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential Winner to be randomly selected from among all remaining eligible entries for the drawing at issue.

7.    WAIVER OF LIABILITY/PUBLICITY RELEASE.  By participating in the Promotion and submitting an entry, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against Sponsor and its parent company, affiliated companies, subsidiaries, and their respective officers, directors, employees, agents, licensees, and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of any prize. By entering this Promotion, each entrant gives his/her express permission to be contacted by the Sponsor by e-mail for Promotion purposes. Acceptance of a Prize constitutes permission to the Sponsor to use Winner’s names and/or likeness for advertising and publicity purposes, without further compensation, except where prohibited by law.

8.    GENERAL CONDITIONS: This Promotion is subject to all applicable federal, state, and local laws and regulations. The laws of the State of Washington govern this Promotion without reference to choice of law principles.  Any dispute regarding the Promotion is exclusively subject to binding arbitration (with one (1) arbitrator sitting) in Seattle, Washington pursuant to the commercial arbitration rules of the American Arbitration Association.  Entrants hereby irrevocably waive any and all right to a trial by jury in any legal proceeding arising out of or relating to the Promotion.  Entrants further waive any objection to venue in Seattle, Washington, whether such objection is based on lack of personal jurisdiction, improper venue, forum non conveniens, or the like.

Entries generated by a script, macro or other mechanical or automated means will be disqualified. In the event of dispute as to the identity or eligibility of any potential Winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address.  Sponsor is not responsible for any misdirected, lost, late, inaccurate or incomplete entries, and such entries will be void. Sponsor is not responsible for: (1) any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability, (2) garbled or jumbled transmissions, (3) service provider/Internet/web site/use net accessibility or availability, traffic congestion, (4) unauthorized human intervention or (5) the incorrect or inaccurate capture of entry information or the failure to capture any such information.

9.    WINNERS’ LIST: The Sponsor of this Promotion is Cheezburger, Inc., 190 Queen Anne Ave. N., Suite 310, Seattle, WA 98109. A list of Winner(s) will be published on the Sponsor’s website at http://icanhascheezburger.com for a month following the end of the Promotion Period and will be available by written request to Sponsor after that period of time.
